Terms of Use

1. Scope

These terms apply to the use of the Pomodo website and app provided by Ameisenhaufen GmbH ("we"). Mandatory consumer protection laws remain unaffected.

2. Service

Pomodo lets you take photos of your food at partner restaurants. For each eligible photo, a meal is donated to a partner organisation at no cost to you. In addition, you can make voluntary direct donations (currently €1.20 per meal).

3. Use without registration

The app can be used without creating an account. You agree not to misuse the service, e.g. by uploading photos that are not taken at a partner restaurant, automating uploads or uploading unlawful content.

4. Photos and content

You retain the rights to your photos. You grant us a simple, non-exclusive right to use them to verify donations and to display them within the app. You must not upload photos showing identifiable persons without their consent.

5. Donations and payments

Direct donations are processed by Stripe. Donations are voluntary and generally non-refundable, as they are passed on to partner organisations. Each donation is assigned to a specific campaign.

6. Availability and liability

We strive for high availability but cannot guarantee uninterrupted service. We are liable without limitation for intent and gross negligence and for personal injury; otherwise liability is excluded to the extent permitted by law.

8. Final provisions

Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, the protection of mandatory law of their country of residence remains unaffected.
